§ 4.7. Vacancies.

A vacancy shall be deemed to occur in an elective office of the City when the incumbent shall die, resign, be recalled, be convicted of a felony, upon a finding of mental incompetence by a court having jurisdiction thereof, or failure to qualify as provided in Section 4.4. A vacancy shall also be deemed to occur in the case of the Mayor or any Councilman, when such officer shall miss three (3) regular meetings of the City Council in any twelve (12) –month period, which absences are not excused by the City Council and the reason therefor entered in the journal of its proceedings.
