§ 1050.07. CITY COUNCIL DETERMINATION OF NECESSITY.

After the public hearing on a proposed project, the City Council may, by resolution, determine to proceed with the improvement and to defray the whole or any part of the cost of the improvement by special assessment upon the property especially benefitted in proportion to the benefits derived or to be derived. The City Council may: determine the public improvement is necessary and approve the preliminary or detailed plans and specifications for the improvement, and, if detailed plans, specifications and cost estimate had not been previously prepared, the resolution may include a direction by City Council to proceed with such preparation; determine the estimated cost; determine what proportion of the benefit from the public improvement shall constitute especial benefit to property within the district so that the cost paid by special assessment upon the respective properties within the district shall be in proportion to such especial benefits, and what part of the benefit from the public improvement, if any, shall be a general benefit to the City at large and thus should be a general obligation of the City; determine the number of installments in which assessments may be paid; designate the district or land and premises upon which special assessments shall be levied; and at such time as detailed plans, specifications and cost estimate have been prepared, depending upon the determination of the City Council relative to the timing of such preparation, direct the City Assessor to prepare a special assessment roll in accordance with the City Council's determination. Without limitation to the City Council's authority as described herein, City Council may add to the special assessment district any property deemed appropriate to the district if the owner of the property agrees to inclusion in the district and waives, in writing, any notice or rights relating to signature of the advisory petition and any notice or rights relating to any action or public hearings conducted prior to inclusion in the district.
